ONLINE TERMS AND CONDITIONS

1. TERMS

1.1 These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and A Jeweller’s Catalogue Pte Ltd. It is important that you read these terms and conditions of sale (“Terms of Sale”) carefully before ordering any Product(s) (“Products”) from ajewellerscatalogue.com / ajc.com (“Site”).

1.2 By placing an order for any Product(s) on this Site (“Order”) you agree to be bound by these Terms of Sale, and by continuing to access the Site you agree to accept the practices described in these Terms of Sale, which may be updated or changed by us from time to time. A regular visit to this page will ensure awareness of any future changes. Your continued use of the Site following such change(s) shall signify your agreement to be bound by our modified Terms of Sale.

1.3 By placing an Order you are offering to purchase a Product on and in accordance with these Terms of Sale. All Orders are dependent on availability and confirmation of the Order price.

1.4 The Site is intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Site.

1.5 The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Site from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

2. ABOUT A JEWELLER’S CATALGOUE

2.2  If we have to contact you we will do so by telephone or by writing to you at the email address you provided to us in your order.

2.3 When we use the words “writing” or “written” in these terms, this includes emails.

3. INTERLECTUAL PROPERTY RIGHTS

3.1 The entire content of the Site, including all jewellery design, copyright, trademarks and other intellectual property rights it contains, including the name ‘A Jeweller’s Catalogue’, is the sole property of A Jeweller’s Catalogue and its licensors. You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on the Site nor may you use any such content in connection with any business or commercial enterprise.

4. PRODCUTS

4.1 We make every effort to display as accurately as possible the colours, features, specifications, and details of the products available on the Site. However, we do not guarantee that the colours, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colours and details of the products. All products are subject to availability, and we cannot guarantee that items will be in stock. We reserve the right to discontinue any products at any time for any reason. Prices for all products are subject to change.

5. PROHIBITED ACTIVITIES

5.1 You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavours except those that are specifically endorsed or approved by us.

5.2 As a user of the Site, you agree not to:

  1. Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
  2. Make any unauthorized use of the Site, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretences.
  3. Use a buying agent or purchasing agent to make purchases on the Site.
  4. Use the Site to advertise or offer to sell goods and services.
  5. Circumvent, disable, or otherwise interfere with security-related features of the Site, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Site and/or the Content contained therein.
  6. Engage in unauthorized framing of or linking to the Site.
  7. Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
  8. Make improper use of our support services or submit false reports of abuse or misconduct.
  9. Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
  10. Interfere with, disrupt, or create an undue burden on the Site or the networks or services connected to the Site.
  11. Attempt to impersonate another user or person or use the username of another user.
  12. Sell or otherwise transfer your profile.
  13. Use any information obtained from the Site in order to harass, abuse, or harm another person.
  14. Use the Site as part of any effort to compete with us or otherwise use the Site and/or the Content for any revenue-generating endeavour or commercial enterprise.
  15. Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Site.
  16. Attempt to bypass any measures of the Site designed to prevent or restrict access to the Site, or any portion of the Site.
  17. Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Site to you.
  18. Delete the copyright or other proprietary rights notice from any Content.
  19. Copy or adapt the Site’s software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.
  20. Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of the Site or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Site.
  21. Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats (“gifs”), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as “spyware” or “passive collection mechanisms” or “pcms”).
  22. Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Site, or using or launching any unauthorized script or other software.
  23. Disparage, tarnish, or otherwise harm, in our opinion, us and/or the Site.
  24. Use the Site in a manner inconsistent with any applicable laws or regulations.

6. PAYMENT

6.1  All payments must be made at the time of Confirmation. Payment for all Orders must be by credit or debit card. We accept payment credit or debit card payments via Visa, MasterCard, American Express, Maestro and Paypal. If we are unable to accept or fulfil your Order for any reason then we will refund any money paid by you in respect of the Order. We will not dispatch the Product(s) until we receive payment in full.

6.2  For payment by card, all credit or debit cardholders and bank account holders respectively may be dependent on authorisation and authentication. If the issuer of your payment card or our service provider refuses to, or does not for any reason authorise or validate the payment, we will not be liable in these circumstances for any delay or non-delivery in respect of the Product(s) which you have ordered as a result.

6.3  To ensure safe and secure shopping. We also use standard internet encryption technology to provide you with the maximum practicable level of security.

6.4  We do not hold any of your payment details anywhere on the Site. They are passed securely to our payments processor for authorisation by your bank or payment provider.

7. PRICE

7.1 When you submit your Order, you are offering to buy the Product(s) at the price set out in the Order.

7.2 Where you are ordering for delivery to the Singapore, all prices are inclusive of GST in Singapore.  Delivery charges (where applicable) for delivery to international delivery will be shown when you view the Product(s) in your Shopping Bag. All delivery is free locally, Singapore.

7.3 For international deliveries import tax and other duties tax are not included while checking out and it is up to the buyer to be familiar with local tax and duties and pay for it. A Jeweller’s Catalogue cannot reimburse for the cost that was paid and is out of the company’s control.

7.6 The total amount payable by you will be displayed before you confirm your Order and will be set out in the confirmatory email you receive from us.

7.7  Our prices may change at any time. If we discover that the price for a Product has changed or that there has been a pricing error when we receive your Order we will contact you and ask if you wish to proceed at the correct price. If you confirm that you do wish to proceed.

7.8  It is always possible that, despite our best efforts, some of the Product(s) we sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the Product(s) correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the Product(s) correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order. If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract, refund you any sums you have paid and require the return of any goods provided to you.

8. DELIVERY

8.1  We aim to deliver Product(s) to the delivery address you have requested in your Order within the time set out in our confirmatory email but we cannot give an exact or guaranteed delivery date.

8.2  If we have not delivered the Product(s) to you within 30 (thirty) days of the date of the Contract, or any other date that we may agree with you, then you may cancel the Contract and we will refund any money paid by you.

8.3  If you still want to accept the delivery after the agreed 30day period, the full amount due will be deduced and if you no longer want it, we will pay for the return fee at our cost for the product(s) to be delivered to us and the full amount that was due for the product will be refunded to you.

9. DAMAGES OR DEFECTIVE PRODCUT(S

9.1  We offer our customers to try on at the comfort of their own home and have a window of 30 days for return if you decide not to keep it. Have to leave the tag on the jewellery or we cannot offer a refund.  We do not offer any warranty.

9.2  You should inspect the Product(s) when you receive them for defects or damage. If you find a defect or damage contact our Customer Care Team as soon as possible with your Order reference number to hand.

9.3  If the Product(s) are found to be damaged prior to delivery to you, or defective (through no fault of your own wearing or use), we will replace the Product(s) or refund the price paid by you, including any delivery charges you paid, provided that you have not worn or used and damaged the Product(s). We will either refund the cost of the return of the Product(s) to us by.

9.4 If the returned items has its original tags off or visible wear and tear on the jewellery, the company holds the right to not refund the customer and the jewellery will be shipped back to the customer at the customer’s cost.

10. LIABILITY

10.1 If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.

10.2  Nothing in these Terms of Sale will limit our liability for:

10.3  fraud; or

10.3  death or personal injury caused as a result of our negligence; or

10.4  or breach of your legal rights in relation to the Product(s) including the right to receive Product(s) which are: as described and match information we provided to you and any sample or model seen or examined by you; of satisfactory quality; fit for any particular purpose made known to us; and supplied with reasonable skill and care.

10.5 We only supply the Products for domestic and private use. If you use the Products for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

11. RETURN/REFUND POLICY and REPAIR

11.1 Please review our Return Policy prior to ordering/making any purchases. We currently do not offer repair but if there is an defect it can be returned to us or exchange.

12.  Returns Without Proof of Purchase

12.1  We will not be able to accept any returns without proof of purchase. Please contact us before you sent it to us as if it is not accepted by us the return fee the buyer will have to bear.

13. PRIVACY

13.1 Our Privacy Policy can be found at Privacy & Security. By consenting to these Terms of Sale, you acknowledge and agree to be bound by the terms of our Privacy Policy, which may be updated from time to time. Please read our Privacy Policy carefully.

14. MISCELLANEOUS

14.1 We will try and solve any disagreements quickly, fairly and efficiently. However, if you are not happy with the way that we deal with any disagreement and you want to begin court proceedings, you must do this within Singapore.
